Episode seven available now on Spotify and Apple
Washington, DC – U.S. Senator Sheldon Whitehouse (D-RI), Chairman of the Senate Judiciary Courts Subcommittee, today released episode seven of his podcast, Making the Case. In the new episode, Whitehouse is joined by retired federal Judge Nancy Gertner to discuss the changes in the behavior of Supreme Court justices in recent years, Judge Gertner’s work on the Presidential Commission on the Supreme Court and ongoing Court reform efforts.
“As a former federal judge, Judge Gertner has a unique perspective on the Supreme Court, and she is one of very few with experience on the bench to speak out about the ongoing ethical problems at the Court,” said Whitehouse. “Tune in as Judge Gertner shares fascinating observations from her time in the federal judiciary and on the Supreme Court commission, her thoughts on how things have changed at the Court, and where the Court goes from here.”

Whitehouse has long been the Senate’s leading voice for improving transparency and accountability at the Supreme Court, delivering a series of speeches on the Senate floor about the special interest scheme to remake the judicial branch.
Whitehouse is working to pass the Supreme Court Ethics, Recusal, and Transparency Act, which was voted out of the Senate Judiciary Committee in July. The bill would require Supreme Court justices to adopt a code of conduct, create a mechanism to investigate alleged violations of the code of conduct and other laws, improve disclosure and transparency when a justice has a connection to a party or amicus before the Court, and require justices to explain their recusal decisions to the public. The Senator has also led legislation to create term limits at the Court.
Earlier this week, Whitehouse and Senate Judiciary Committee Chair Dick Durbin (D-IL) announced that the Judiciary Committee will vote to authorize issuing subpoenas to Harlan Crow, Leonard Leo, and Robin Arkley II related to the Committee’s Supreme Court ethics investigation.
